Matthew’s knowledge of negotiating construction documentation, derived from his extensive in-house experience at John Laing plc, Jarvis Plc and Montpellier Group plc, means that MJD Solicitors are entirely at home in contract negotiations where employers have engaged teams of lawyers from city of London law firms. Matthew frequently secures favourable terms for his clients ensuring that off-market risk is eliminated, and any risk that is accepted is priced and understood.

Matthew is regularly instructed to review and negotiate across the suite of JCT Main contracts. Mathew can both advise on the risk profile of the amendments and draft necessary revisions and negotiate to secure the same. Matthew’s significant experience means that he is usually at least as qualified and experienced as the employer’s representatives. The common employer position – “your request is off market” – if deployed, is usually eventually conceded.

MJD experience includes:

  • Negotiating and drafting on over 100 JCT 2016 Main Contracts where the employers were represented by leading London law and property professionals.
  • Advised Main Contractor on JCT DB 2016 and associated documents in relation to new warehouse facility. Complex negotiations involved solicitors representing Employer, Freeholder and Funder.
  • Advised Main Contractor on JCT DB 2016 in relation to new office facility in the city. Protracted negotiations caused by extremely onerous set of amendments and the Employer having agreed to unrealistic terms in Agreement for Lease.   
  • Advised Main Contractor on various warehouse refurbishment projects where contract was to be JCT DB 2016.
  • Advised Main Contractors on flow down of JCT Contract to subcontractors and professional team on hotel complex development.
  • Prepared bespoke terms of trading for Main Contractors to ensure adequate risk management.
